Terms of Use

1. Acceptance of Terms

By accessing our website and submitting your contact information to join the Lution launch list, request service, or otherwise interact with us, you agree to be bound by these Terms of Use. If you do not agree to these terms, please do not use our website or submit your information.

2. Launch List Registration

When you join our launch list, you consent to providing your name, email address, mailing address, and (if you choose) mobile phone number. This information will be used only for the purposes outlined in our Privacy Policy and in these Terms.

3. Communications and Use of Information

By joining our launch list, you agree to receive from us, through our service providers, by email:

  • Product updates and announcements about Lution
  • Marketing communications about our products and services
  • Early access opportunities and special offers
  • Information about product availability and launch dates
  • Transactional messages related to orders, subscriptions, shipments, and support

You may unsubscribe from marketing emails at any time by clicking the "unsubscribe" link in any email we send you or by contacting us at hello@lutionlabs.com. Transactional messages related to an order, account, or device may continue for as long as needed to service that request.

Separately, you may choose to receive text (SMS) messages from Lution on the terms described in Section 4 below. Consent to SMS messages is never required to purchase any product or service.

4. SMS / Text Message Program

Program description. The Lution Company (“Lution,” “we,” “us”) operates a recurring text messaging program (the “SMS Program”) that communicates with subscribers in the United States. Message and data rates may apply. Message frequency varies based on your activity and preferences.

4.1 Express Written Consent

By providing your mobile phone number and affirmatively checking the SMS consent box on a Lution sign-up form, you give Lution express written consent under the Telephone Consumer Protection Act (47 U.S.C. § 227) and its implementing rules (47 C.F.R. § 64.1200) to send you recurring autodialed, automated, and/or AI-generated text messages to that mobile number. You understand that your consent is not required as a condition of purchasing any goods or services from Lution, and that you may opt out at any time as described below.

4.2 Types of Messages You May Receive

Depending on the programs you have opted into and your interactions with Lution, SMS messages may include:

  • Marketing messages — product announcements, early-access invitations, launch information, discounts, and promotional content (only if you affirmatively opt in).
  • Transactional messages — order confirmations, shipping and delivery updates, filter replenishment reminders, subscription management, lab report availability, and customer support replies.
  • Service and environmental alerts — air-quality alerts for your location, device status (for example, offline or requires attention), and filter-change reminders.
  • Account and security messages — two-factor authentication (2FA) codes, login verification, password-reset confirmations, and account-security notices.

4.3 How to Opt Out (STOP)

You may cancel the SMS Program at any time by texting STOP (or any of the following: CANCEL, END, QUIT, UNSUBSCRIBE) to any message you receive from Lution. After you send a STOP message, you will receive one final text confirming that you have been unsubscribed. After that, you will no longer receive SMS messages from us in that program. If you want to rejoin, sign up again as you did the first time. You may also opt out of SMS at any time by emailing hello@lutionlabs.com with your phone number and the word “STOP.”

4.4 Help (HELP)

4.5 Message Frequency

Message frequency varies. Marketing subscribers may receive up to approximately 4 promotional messages per month. Transactional, service-alert, and 2FA messages are sent only in response to your activity (for example, placing an order, a sensor detecting an event, or attempting to sign in) and may occur more frequently during active use of Lution devices and services.

4.6 Cost, Carriers, and Delivery

Message and data rates may apply. Lution does not charge for SMS messages, but your mobile carrier may charge standard messaging and data rates according to your plan. Check with your wireless carrier for details. The SMS Program is supported by major U.S. carriers, including AT&T, T-Mobile, Verizon Wireless, Sprint, U.S. Cellular, Boost, Cricket, MetroPCS, and others. Carriers are not liable for delayed or undelivered messages.

4.7 Eligibility and Accuracy

You must be at least 18 years old and the account holder of, or have authority to consent on behalf of the account holder of, the mobile phone number you submit. You represent that the mobile number you provide is your own and is not a land line. You agree to notify Lution promptly if you change or relinquish your mobile number by emailing hello@lutionlabs.com.

4.8 Privacy

Information you provide in connection with the SMS Program is handled in accordance with our Privacy Policy. We do not sell, rent, or share your mobile phone number or SMS opt-in consent with any third party or affiliate for their marketing or promotional purposes.

4.9 Changes

We reserve the right to change or terminate the SMS Program, including any short code or sender ID used, at any time without notice. Your continued participation after a change constitutes your acceptance of the change.

5. Use of Website

You agree to use this website only for lawful purposes and in a manner that does not infringe the rights of, or restrict or inhibit the use of this site by any third party.

6. Intellectual Property

All content on this website, including but not limited to text, graphics, logos, images, and software, is the property of The Lution Company and is protected by United States and international copyright and trademark laws.

7. Disclaimer of Warranties

This website and all information provided are offered "as is" without warranty of any kind, either express or implied. We do not warrant that the website will be uninterrupted or error-free.

8. Limitation of Liability

The Lution Company shall not be liable for any direct, indirect, incidental, special, or consequential damages resulting from the use or inability to use this website or services.

9. Changes to Terms

We reserve the right to modify these Terms of Use at any time. Changes will be effective immediately upon posting to this website. Your continued use of the website after changes are posted constitutes your acceptance of the modified terms.

10. Governing Law

These Terms of Use shall be governed by and construed in accordance with the laws of the State of California, without regard to its conflict of law provisions.
